ПРАВОНАСТУПНИЦТВО ДЕРЖАВ: НОВИЙ ПОГЛЯД НА СТАРУ ПРОБЛЕМУ

Abstract

Розглянуто засоби подолання проблеми необов'язковості зобов'язань держави-попередниці для держав-наступниць. Наоснові концепцій Д.П.О'Конела та М.Кравена розроблено новий підхід до правонаступництва держав, який би на підставівизначення ступеня ідентичності держави-наступниці і держави-попередниці забезпечував континуїтет міжнародних правта обов'язків останньої.This paper deals with the problem of non-mandatory effect of the predecessor state's obligations for its successor states, whichemerge as new states. The author analyzes the uncommon approaches to the above issue propagated by D.P.O'Connell and M.Cravenand, based thereupon, suggests her own approach. Such an approach would ground upon the determination of the identity level of asuccessor state and predecessor state and provide for the continuity of the latter's rights and obligations.
